Concert Inclement Weather for KING JEREMY

Notwithstanding anything contained herein, inclement weather shall not be deemed to be a force majeure and the PURCHASER shall remain liable for payment of the full contract price even if the performance(s) called for herein are prevented by such weather conditions. ARTIST shall have the sole right to determine in good faith whether any such weather conditions. ARTIST shall have the sole right to determine in good faith whether any such weather conditions shall render the performance(s) impossible, hazardous or unsafe.

Concert Arbitration for KING JEREMY

Any controversy or claim arising out of or in relation to this agreement or the breach thereof may be settled at the election of PRODUCER by Arbitration in Eugene, Oregon, in accordance with rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.

Concert Postponement/Cancellation for King Jeremy

PURCHASER agrees that ARTIST may postpone or cancel the engagement hereunder by giving the PURCHASER written notice thereof at least thirty (30) days prior to the commencement date of the engagement(s) hereunder.

Concert Force Majeure for KING JEREMY

ARTIST'S obligations to furnish the entertainment unit referred to herein is subject to the detention or prevention by sickness, inability to perform, accident, means of transportation, Act of God, riots, strikes, labor difficulties, epidemics and any act or order of any public authority or any cause, similar or dissimilar, beyond ARTIST'S control. Provided ARTIST is ready, willing and able to perform, PURCHASER agrees to compensate ARTIST in accordance with the terms hereof regardless of Act of God, fire, accident, riot, strike or any events of any kind or character whatsoever, whether similar or dissimilar to the foregoing events which would prevent or interfere with the presentation of the show hereunder.

Concert Union Obligations for King Jeremy

In the Event there are any local union charges in connection with any of the personnel or services furnished by PURCHASER, PURCHASER agrees to assume all costs in connection therewith. In any union restrictions prevents the sound man and assistant from loading equipment called under this agreement, PURCHASER agrees it will abide by any union regulations which govern this matter and assume all costs in connection therewith.

Concert Concessions for King Jeremy

Upon return of the signed agreement to PRODUCER, PURCHASER agrees that he must also provide a Letter of Agreement between himself and the building management and/or concessionaire of the place of engagement stating that no one shall be permitted to sell any souvenir merchandise and/or record albums in connection with the engagement hereunder other than the official ARTIST'S Souvenir Program Book merchandise and/or posters by the Publishing Company and ARTIST'S record albums and such other items as may be authorized by PRODUCER. A representative of the Publishing Company will make the necessary arrangements for the sale of all such souvenir merchandise and ARTIST'S record albums and no other person is authorized to do so. PURCHASER under no circumstances has the right to sell any facsimile of the ARTIST, including but not limited to program books, playbills, photographs, without written permission for the program books and posters to pay to the person with whom such arrangements are made and amount equal to ten percent (10%) of such receipts if such if such person furnishes such personnel to sell such souvenir merchandise.

Concert Ticket Sales, Box Office, etc. for KING JEREMY

PURCHASER agrees to deliver to ARTIST'S Management Office, within two (2) weeks after receiving the contract, a printer's manifest of the house (notarized signed statement from the printer of tickets) listing amount of tickets printed at each price. PURCHASER FURTHER agrees to have an on hand all unsold tickets at the place of performance the night of the engagement for counting and verification by ARTIST or ARTIST'S  representative shall be deemed to have been sold by PURCHASER. The applicable section ticket price for which the price is? For each such ticket not shown as unsold hereunder shall be used to compute the receipts upon which the compensation payable to ARTIST hereunder shall be based. PURCHASER further agrees to give ARTIST or ARTIST'S representative the right to enter the box office at any time before, during and after the performance(s) hereunder and to examine and make extracts from the box office records of the PURCHASER relating to the gross receipts of the engagement hereunder. A written box office statement certified statement signed by the PURCHASER that will be furnished to the ARTIST prior to intermission, if any, or during the performance(s) hereunder as part of a series of other concerts. PURCHASER shall not discount tickets at a premium without first obtaining permission in writing from PRODUCER. Each discount ticket or premium ticket sold or distributed by PURCHASER without PRODUCER'S prior written approval or in excess of the number permitted by PRODUCER shall be deemed sold and the section ticket price for which the house is scaled for such ticket(s) shall be used to compute the receipts upon which the compensation payable to ARTIST hereunder shall be used. The complimentary tickets issued by PURCHASER shall not exceed one percent (1%) of the entire seating capacity of the place of the engagement(s). Complimentary tickets utilized by PURCHASER shall be limited to the legitimate representatives of radio and television stations and newspapers in the city of performance. A list of said persons to whom complimentary tickets are being issued shall be delivered to PRODUCER on the night of the engagement. If any such complimentary ticket is used by any person other than one authorized by this paragraph then it shall be deemed sold and the applicable section ticket price for such ticket(s) shall be used to compute the receipts upon which compensation to ARTIST hereunder shall be used.
